Aam Aadmi Party (AAP) MLA Naresh Balyan faced rearrest under the Maharashtra Control of Organised Crime Act (MCOCA) on Wednesday, just after receiving bail in an extortion case from a Delhi court.
Rearrest Follows Bail Approval
Naresh Balyan was granted bail by Additional Chief Metropolitan Magistrate Paras Dalal on a personal bond of ₹50,000 with one surety. However, shortly after his release, he was taken into custody again by Delhi Police. They alleged his involvement in a conspiracy linked to an “extortion syndicate.”
The court dismissed the police’s plea for 14-day judicial custody and deemed their request for rearrest under MCOCA as “not maintainable.”
Police Claim Non-Cooperation
According to the Delhi Police, Balyan was uncooperative during the investigation. They argued that his custodial interrogation was essential to uncover the roles of others involved in the alleged extortion network.
Defense Calls Arrest “Political”
Balyan’s counsel labeled the arrest as “illegal” and “politically motivated.” The defense argued that the grounds for arrest were not shared in writing with the accused.
Timeline of Events

- Tuesday: Police secured one-day custody of Balyan.
- Wednesday: Bail granted; rearrest followed under MCOCA.
AAP Responds
The Aam Aadmi Party described the charges against Balyan as “baseless.” The party accused the police of targeting their MLA for political reasons, further intensifying the controversy surrounding the case.
This development has triggered a heated debate, with questions about the use of stringent laws like MCOCA in political cases.
