Delhi HC Grants Bail, Stresses Distinction Between Rape and Failed Relationships
The Delhi High Court granted bail to a man accused of rape, emphasizing the need to distinguish between sexual assault and consensual relationships that later turn bitter.
Justice Neena Bansal Krishna noted that while lawmakers must protect women at workplaces, courts have a duty to prevent the misuse of legal provisions. She pointed out that many workplace relationships begin consensually but, after turning sour, are reported as crimes.
Case Background
The court examined a case where a man and woman, working at the same company, entered a consensual relationship. After a year, their relationship ended, leading to allegations of rape.
The accused claimed they had been deeply in love, but the complainant later started dating someone else. He alleged that she filed the complaint to settle scores.
Court’s Observations
The court stated that the accused had been in custody since May 2024, and there was no justification for prolonged incarceration. Since charges were already framed, the trial would determine the truth of the allegations. The police, however, opposed his bail.
POCSO Case Ruling
In another case, the Delhi High Court ruled that claims of consensual relationships hold no legal value in cases involving minors. The court clarified that under the POCSO Act, a minor cannot give valid consent.
“The alleged consensual nature of the relationship is legally irrelevant for prosecution under the POCSO Act,” the court stated in its February 3 order.
