Orissa High Court Permits Abortion for 13-Year-Old Rape Survivor The Orissa High Court has granted permission for a 13-year-old rape survivor from Kandhamal district to undergo a medical abortion, considering the serious risks to her health. The minor, who suffers from sickle cell anemia and epilepsy, was sexually assaulted but remained silent due to threats. Health Risks and Legal Proceedings The case came to light when her mother sought medical attention due to her deteriorating health. Doctors confirmed that she was over 27 weeks pregnant, exceeding the 24-week legal limit under the Medical Termination of Pregnancy (MTP) Act. Her father filed a petition before the Orissa High Court, seeking permission for an abortion due to the life-threatening complications involved. Following the court’s direction, the MKCG Medical College and Hospital in Berhampur conducted a medical evaluation. The Medical Board concluded that continuing the pregnancy would severely impact the minor’s physical and mental well-being. The court directed the state to develop a Standard Operating Procedure (SOP) within six months to: Ensure timely access to reproductive healthcare. Reduce bureaucratic hurdles in medical termination cases. Train law enforcement agencies to handle such cases more effectively.
